Illegal Fireworks

Fireworks that do not bare the State Fire Marshal seal on the packaging are illegal in California.  Each year serious injuries and millions of dollars in property loss occur from wildfires sparked by fireworks. Large grass crops and dry vegetation increase the threat for devastating fires throughout all of California. Fireworks are dangerous and have caused many fires, costly property damage, and severe injury. Fireworks are also frightening to many pets and wildlife with the peak loss of pets during the year occurring on the 4th of July. Fireworks are also toxic pollutants both to air and water. 

Fireworks that include rockets, aerial missiles and spinners, roman candle-types, firecrackers, M-80, M-1000, and any other devices (combination or novelty) that is structurally or functionally similar to any of these designs are considered illegal. 

Under California Health and Safety Code Fireworks Penalties, Section 12700(B), a person in possession of unaltered dangerous (illegal) fireworks in violation of the State Fireworks Law is punishable as a misdemeanor or a public offense with fines ranging from $500 to more than $50,000, depending on the gross weight of unaltered dangerous fireworks in possession.   

Illegal Fireworks Ordinance 

On November 20, 2012, the Suisun City Council adopted Ordinance No. 722 setting the penalty for possession, use, storage, sale, and/or display of illegal fireworks as follows:

Social Host Ordinance

Any social host shall be strictly liable and subject to a fine for any unlawful ignition, use, discharge or display of any illegal fireworks property or gathering.  Citations will be sent in the mail to the owner, even if a renter or guest commits the crime.  Penalties for Social Host Violations are as follows:

$1,000.00 for a first violation;

$1,500.00 for a second violation within a 12-month period;

$2,000.00 for a third violation within a 12-month period.

All fines that are not timely paid or appealed are subject to a ten percent late fee.
